Zhang Zhijie: Procuratorial organs have fought a tough battle against pollution by carrying out special supervision activities for crimes against environmental resources. In recent years, the procuratorial organs throughout the country have resolutely implemented the arrangements of the CPC Central Committee, focused on the environmental pollution problems strongly reflected by the people, and deployed and carried out the "special case-filing supervision activities for crimes against environmental resources" for five consecutive years to serve the construction of beautiful China.
Zhang Zhijie: Since 2018, the procuratorial organs have focused on the following aspects: First, in 2018, the Supreme People’s Procuratorate alone or jointly with the Ministry of Public Security, the Ministry of Environmental Protection and other functional departments listed and supervised 50 major environmental resources crime cases, and adopted on-site guidance and joint supervision to strengthen the follow-up supervision of major cases with serious harm and strong social repercussions. Zhang Zhijie: In recent years, telecommunication network fraud has seriously infringed on people’s property safety and legitimate rights and interests, and seriously affected people’s sense of security. For three consecutive years, the Supreme People’s Procuratorate has made it a key task to crack down on the crime of telecommunication network fraud. It has deployed and required procuratorial organs at all levels throughout the country to deeply understand the significance of handling such cases from the height of comprehensively promoting the rule of law, consolidating the party’s ruling position, and safeguarding the country’s long-term stability, give full play to the linkage between the upper and lower levels, form a joint effort to crack down on telecommunication network fraud crimes, and resolutely curb the high incidence and spread of telecommunication network fraud. How can procuratorial organs play the role of guiding cases, defend the interests of defenders and respond to the concerns of the masses?
Zhang Zhijie: Self-defense is a basic right given to citizens by law and an important means to fight against illegal acts. According to the provisions of China’s criminal law, in order to protect the state, public interests, personal, property and other rights of oneself or others from ongoing illegal infringement, the act of stopping illegal infringement, which causes damage to the illegal infringer, belongs to self-defense and does not bear criminal responsibility. At the same time, the criminal law also stipulates that if justifiable defense obviously exceeds the necessary limit and causes great damage, it shall bear criminal responsibility, but the punishment shall be mitigated or exempted. It can be seen that it is necessary to grasp the "degree" of legitimate defense.
Zhang Zhijie: The Supreme People’s Procuratorate recently issued the twelfth batch of guiding cases, namely, Chen Mou’s justifiable defense case, Zhu Fengshan’s intentional injury (excessive defense) case, Yu Haiming’s justifiable defense case and Hou Yuqiu’s justifiable defense case. These four cases are cases of self-defense or excessive self-defense. This paper specifically explains the boundaries and standards of self-defense, further clarifies the protection of the right of self-defense, actively solves the outstanding problems in the application of self-defense, and provides reference for judicial handling.
Zhang Zhijie: For example, the case of Chen Mou’s justifiable defense is aimed at the general defense, which mainly clarifies that in the case of being beaten and personal rights being illegally violated, although the defense behavior has caused objective consequences of great damage, the defense measures have not obviously exceeded the necessary limits, which is not excessive defense and does not bear criminal responsibility according to law. In addition, self-defense can not only protect one’s own legitimate rights and interests, but also protect the legitimate rights and interests of others. Paragraph 2 of Article 6 of the Law of People’s Republic of China (PRC) on the Protection of Minors also stipulates that "any organization or individual has the right to dissuade, stop or report or accuse any act that infringes on the legitimate rights and interests of minors". Zhang Zhijie: Zhu Fengshan’s intentional injury (excessive defense) case involves civil contradictions. This guiding case is aimed at the problem of excessive defense. It is clearly pointed out that during the intensification of civil contradictions, legitimate defense can be carried out against the ongoing illegal invasion of houses and minor personal violations, but the intensity of defense is unnecessary and causes serious injuries and deaths to the illegal infringer, which obviously exceeds the necessary limit and causes great damage, and criminal responsibility should be borne, but punishment should be mitigated or exempted.
Zhang Zhijie: Yu Haiming’s self-defense case (Kunshan Longge case) and Hou Yuqiu’s self-defense case, aiming at the problem of special defense, respectively defined the identification standards of "assault" and "other violent crimes that seriously endanger personal safety".
